Dear M. Miller:
When I met on the job early this month with Mr. Newlin and Mr. Taylor, there was some suggestion that the job was not progressing because the contractor felt he was being forced to do work in excess of his contract.
It was agreed that he would submit a list of such work and I am enclosing a copy of his letter and offering the following comments on it.
Item 1. This is a fair price for the work. It is our feeling that it is not a legitimate extra and under normal circumstances we would not allow it to be proposed. We are subscribing to it now only in the interests of saving time.
Item 2. This is a legitimate extra for this change.
Item 3. Virgil's dates do not tell the whole story on this one. The final proposal was prepared between September 26 and October 5.
Actually you approved the final proposal on October 1, subject to certain modifications. We advised Virgil, by letter, of this on October 2 and instructed him to proceed with the work. We received the final adjusted quotation from him on October 5 and as I assumed that it had clearly understood that he was to proceed with the work, I waited until I had a number of other items to discuss with you before sending him a formal letter.
Since it should have been obvious when he priced it that the work could not be finished before cold weather, this extra can only proposed as an inducement to Virgil to expedite the job.
Item 4. This is for some additional finishing by Foss and is fair.
